@kausmickey
Hey Mickey,
My husband taught at Harvard Law, as did his father. Cruz is wrong if strict constituitonalist.
@kausmickey He’s directly contradicting what he wrote with Ted Olson for McCain on the point. Shameless.
@kausmickey If Cruz wants to “interpret” the constitution, then hell, it could mean anything which might be convenient for him at the time.
@kausmickey Dude. The best thing about Trump was he got people to fight on his turf. Let’s go into a constitutional issue with Cruz?
@wrdcsc @kausmickey Article also implies that only two theories of const. interp. are “living const’lism” and old-style originalism. Blergh.
@djsziff @kausmickey Yup.
@kausmickey The joke of it is, Ted would not deport *anyone* ever. Remember: https://t.co/OQWvSXksMc
@kausmickey He’s saying that only he, Tribe, is qualified to decide whether Cruz is a “natural born citizen”
@wrdcsc @kausmickey Tribe explains difference here https://t.co/kXkjfjMX2B
@djsziff @wrdcsc @kausmickey Doesn’t imply that all. He says those are Cruz’ & his theories. Never says there aren’t others
@kausmickey Do you doubt for a second that Scalia’s vote on the question would be based on who the candidate is?
@PrimeNewYork @kausmickey No, the 08 paper had 2 independent grounds. So this is even worse than ignoring it. Territory arg. was 2d.
