HELL OF SMITH: It really is worth reliving the horrifying details of that Justin Smith Atlantic party. https://t.co/qBqQDRNnBn When you look up “social inequality” in the dictionary …Yet the party’s theme was “The American Idea” … I would rather be stuck on 1-95 for 15 hours.

Agree that partisan state courts aren’t necessarily much better than state legislatures. That’s why I’d ultimately rely on US Supreme Court. At least they are a third-party federal review. Presumably they’re less partisan than Congress–though Bush v Gore a glaring counterexample https://t.co/vB7BzP15eW

Ultimately, solution is to amend Constitution to eliminate role of state legislatures. Until then have to assume SCOTUS will cook up some fancy (14th Amendments? Denying right to vote without Due Process?) grounds for intervening and throwing out the legislature’s bogus slate.

Don’t think @baseballcrank’s suggestion at end of this piece (https://t.co/Z7AuTEHBjG) solve probem either. A court is going to overturn electors–already approved by Congress!–because fraud or voter suppression was not “massive” enough? Don’t see it.

I still think even changing Electoral Count Act doesn’t solve problem of, say, a GA GOP legislature that (claiming fraud) sends a slate of electors in defiance of apparent vote results. You WANT legislature’s slate thrown out, yet GOP Congress might approve (esp if 2/3 required) https://t.co/yrqDELKDOw

The earnings requirement (eliminated in Biden’s Rescue Plan and in BBB) was not onerous — $2,500 a year. A little more than $200 a month. Just to require *some* connection to the labor market before you claimed a “tax credit” check (even if you paid no tax). https://t.co/H0OXh68tWx

The left’ll want to give Manchin a tougher “means-test”-eg don’t send cash to $400K couples-if he’ll only keep no-work “refundability.” That’d be a bad outcome, as I think Manchin knows. We can help millions without creating a culture of non-work if we keep the old earnings test. https://t.co/bSES6KjnpO
