Penalty=tax, state=feds, must=should, what difference does it make?
Does it matter? I think it is a practical “should” given that the Court has no way to enforce it’s opinion. Underscores the importance of retaining the confidence of the American people and not over reaching on 5-4 votes to create fundamental Constitutional changes.
